Privacy Policy

This Privacy Policy (“Policy”) describes how your personal data is collected, used, and shared by PAPATUI LLC (“PAPATUI,” “we,” “us” and “our”) and applies when you visit or purchase products from the Papatui LLC (“Papatui”) website at papatui.com, interact with our social media pages, or wherever this Privacy Policy is posted (the “Sites”). “Personal data ” is information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular individual or household.   

This Policy does not apply to third-party websites, mobile applications, or services that may link to the Sites or be linked to from the Sites. Please review the privacy policies on those websites and applications directly to understand their privacy practices.

We may update this Privacy Policy from time to time, as detailed below. You should not use the Sites if you have any objections to our Policy. If we make a material change to the Policy, we will notify you via email. If you have a question about how your personal data is being used, you can contact us through the methods provided in the “Contact Us” section at the end of this Privacy Policy.

NOTICE AT COLLECTION 

We may collect the following personal data to provide our Sites and products: identifiers and contact data; commercial data; demographic data; location data (i.e., from IP address); communications data; inferences from other data; internet and other network activity and employment, and sensitive personal data. Please see “Personal Data We Collect and the Sources of that Data” for more information. We collect this personal data to provide our products and Sites; communicate with you; provide, maintain, protect, and improve our Sites; tailor content and engage in advertising and marketing; comply with legal requirements; and for other reasons listed in the section, “How We Use Your Personal Data.” PAPATUI may communicate or disclose your personal data to service providers, and third parties, as outlined in “How We Disclose Your Personal Data.” We will retain your information for as long as needed to fulfill the purpose(s) for which it was collected and to comply with our legal obligations, resolve disputes, and enforce our agreements. Subject to applicable law, we only collect sensitive personal data to provide our products or Sites. 

In order to provide you with more personalized and relevant content, we work with third party advertising and analytics providers, which may be considered a ”sale” or “sharing” for targeted advertising purposes, as those terms are defined under applicable privacy laws. We may sell or share your basic name and contact information, online activity information, commercial data, demographic data, video viewing history, location data, sensitive personal data, and any other information you provide where cookies are present. While we take steps to protect your personal data, data transferred over the internet can never be absolutely secure. Accordingly, we cannot 100% guarantee the security of your personal data we process

PERSONAL DATA WE COLLECT AND THE SOURCES OF THAT DATA

Within the past 12 months, we have collected or processes the following categories of personal data as part of our business:

  • Identifiers: name; contact information (like email or physical address); and account username. This data is collected directly from you, from other parties like social media platforms, or from data analytics and advertising providers when you interact with our Sites.
  • Commercial Data: purchase history; billing and shipping information; and any other personal data about your transactions with us. This data is collected directly from you when you buy something from us, from data analytics and advertising providers when you interact with our Sites, or from retail partners and service providers, like vendors who process payments on our behalf. 
  • Financial Data: payment card information or payment app information. This data is collected directly from you via our service providers when you buy something from us. 
  • Internet or Other Network Activity: device ID and operating system; browser information; IP address; Internet activity or social media activity; information about how you interact with our Sites. This data is collected from data analytics and advertising providers or from other parties like social media platforms when you interact with our social media accounts or pages, or interact with our ads on those pages. 
  • Audio, Electronic, Video, or Similar Data: videos or photos taken at our events; recordings of customer support calls; or videos or images you submit to us or post on our social media pages. This data is collected directly from you when you contact us, attend our events, or interact with certain features of our Sites. We may also collect this data from service providers when you contact customer support. 
  • Location information: location information, such as IP address, that describes your general location.  This data is collected directly from you, from data analytics and advertising providers, or from other parties like social media platforms. We do not collect precise geolocation data, such as GPS data. 
  • Content of Communications: contents of phone calls, texts, or chats; any audiovisual information provided in your communications. This data is collected directly from you when you contact us or interact with our Sites, or from service providers when you contact customer support. 
  • Demographic Data: gender or age. This data is collected directly from you, if you choose to provide this data when you contact us or interact with our Sites.
  • Video Viewing History: personal data relating to any video content, audiovisual content, or content of a like nature. This data is collected directly from you when you interact with our Sites or from data analytics and advertising providers via pixels or similar technologies when you interact with our Sites.
  • Social Media Activity: including social media interactions, photos or video content, tweets, and profile information, such as number of followers. We collect this information directly from you when you attend our events, or from other parties like social media platforms. 
  • Sensitive personal data: account login and password information when you create an account to purchase products through our Sites. 
  • Inferences from Other Related Data: new information that we generate about your likely preferences, hobbies, interests, or other characteristics from any of the categories of personal data outlined above. We do not use sensitive personal data to create inferences about you. 

HOW WE USE YOUR PERSONAL DATA

We may process any of the personal data we describe above for the following purposes: 

  • Basic business operations. To provide our Sites and sell you our products, like processing payments, shipping products, sending appointment reminders, and accounting. 
  • Sites, service, or product improvement. We use your personal data for internal business purposes, such as to improve and grow our Sites and products, including to develop new products and understand how our Sites and products are being used, our customer base and purchasing trends, and the effectiveness of our marketing.
  • Advertising and Marketing. To send you marketing, to personalize the ads you see on our Sites or other sites, and to see how well those ads work. 
  • Security. To protect our Sites, network, and business operations, and to stop activities that may violate our policies or be fraudulent or illegal.
  • Legal compliance. To comply with legal process like warrants or court orders, and to comply with law. 

HOW WE DISCLOSE YOUR PERSONAL DATA 

  • Within our business. 
  • With service providers, vendors, or retail partners in the context of our business relationship with those parties. 
  • During a change in ownership, such as a merger or bankruptcy, your personal data may be reviewed and transferred along with other business assets.
  • Where we have received your direction or consent for the disclosure of your personal data, such as when we post photos or videos of our events on our social media pages. 
  • To fulfill a service to you or to respond to communications from you.  
  • To comply with the law or respond to legal process or lawful requests, including from law enforcement and government agencies. 
  • To investigate complaints or possible breaches of law, to protect the integrity of the Sites, to fulfill your requests, or to cooperate in any legal investigation. 
  • To protect the rights or property of PAPATUI or our customers, including enforcing the terms governing your use of the Services. 
  • To act on a good faith belief that access or disclosure is necessary to protect the health and/or safety of our employees, customers, or the public. 

SALE OR SHARING OF PERSONAL DATA 

To personalize our ads and marketing experiences, we work with ad and analytics partners, ad networks, and social media sites. These partnerships may be considered a ”sale” or “sharing for targeted advertising purposes” under some US laws, even when no money exchanges hands. 

For example, when you log in to your account on a web page where cookies are present, that may be considered a “sale” or “sharing” of your personal data. The personal data we might “sell” or “share” includes your basic name and contact information, online activity information, commercial data, and sensitive personal data. PAPATUI does not sell or share the personal data of children under the age of 16.  

COOKIES AND SIMILAR TARGETING TECHNOLOGIES

(1) Cookies Used by Us

We use, and may allow certain third parties to use (including advertisers, third party ad networks, and other ad companies), cookies, web beacons, social media pixels, and other similar online targeting technologies (together, “cookies”) to provide our Sites and products, serve advertisements on the Sites, and to improve the performance of our advertising across the Internet. 

A web beacon is an electronic image, also called a "gif," that may be in the form of a "png" image, as well as iframe, script, input link, embed, object, and other tags to track usage. These web beacons may be used on our web pages to deliver cookies, count visits and compile statistics on usage and effectiveness of our Sites. We may also use “pixel tags,” such as the Meta Pixel, on our Sites to measure your use of our Sites, tailor our Sites to your interests, and improve our Sites. Please note that through the Meta Pixel, Facebook can connect this data with your Facebook account and use it for its own advertising purposes, in accordance with Facebook’s Data Policy which can be found at Facebook.com/about/privacy/.  

Please be advised that these cookie providers, such as advertising companies, may gather personal data about your visit to the Sites or other websites to enable them to market products or services to you, to monitor which ads have been served to your browser and which webpages you were viewing when such ads were delivered. If you are based in the European Economic Area or another country which requires express consent for the use of certain kinds of cookies and of similar technologies, we will comply with such consent requirements.

Depending on the particular advertising services they provide, these third party advertising companies may employ first-party cookies or third-party cookies. Unlike third-party cookies, first-party cookies are hosted on PAPATUI’s servers. 

The types of cookies used on the Sites can be categorized as follows:

  • Essential or Strictly Necessary Cookies are essential to our Sites and allow you to navigate and use their features. They also help authenticate users and prevent fraudulent use of your account. 
  • Performance and Analytics Cookies, which are sometimes called “analytics cookies,” enable us to improve our Sites and services by seeing which areas and features are most popular and to count the number of computers or mobile devices accessing our Sites.
  • Functional Cookies allow us to personalize and improve your experience by recording your preferences, which allows you to visit our Sites without re-entering your username and/or password. 
  • Targeting or Advertising Cookies are used by CS and third parties to deliver ads we believe are more relevant to you and your interests, to improve the performance of our advertising across the Internet, and to limit the number of times that you see an ad on our Sites.

The categories of personal data collected via these cookies is described in the section, “Personal Data We Collect and the Sources of that Data.” How long these cookies stay on your computer or phone depends on what they need to do. For example, some cookies only work while you're using the Sites and get deleted when you're done (session cookies). PLEASE NOTE THAT THIS POLICY DOES NOT COVER THE COLLECTION AND USE OF INFORMATION BY SUCH THIRD PARTY WEBSITES AND ADVERTISING COMPANIES.

For Google Analytics:  To help facilitate the delivery of relevant content, we use Google Analytics and have implemented all Google Advertising Features, including Remarketing, Impression Reporting, and Demographics, and Interest Reporting. Google Analytics uses cookies to report on user interactions on our and others' websites. We use the data collected for optimizing marketing, refining advertising and/or programming strategies, and generally making advertising more effective. We will not undertake such activities without your consent where such consent is required under applicable law. Note that the opt-out is specific to Google activities and does not affect the activities of other ad networks or analytics providers that we may use.

DISCLAIMER REGARDING VIDEO CONTENT

The Sites may contain social media pixels, cookies, or other similar targeting tools which provide us and third parties with analytics regarding how website visitors interact with video content, audiovisual content, or content of a like nature. You may see targeted advertising on third-party websites or platforms because of these tools. Video content is provided to enhance the user experience on the Sites. You understand that your personal data, including your video viewing history, may be processed according to this Privacy Statement and our Cookie Policy. Please note that this Privacy Policy does not apply to personal data collection via third-party video content on our Sites. Please review the privacy policies of those third parties to understand their information practices.   

PUBLIC POSTING AREAS AND SOCIAL MEDIA PAGES

Please note that any personal data you include in a message you post to any public posting area, such as the comment section of our Sites, is available to anyone with Internet access. If you don't want people to know your email address, for example, don't include it in any message you post publicly. PLEASE BE EXTREMELY CAREFUL WHEN DISCLOSING ANY INFORMATION IN PUBLIC POSTING AREAS. WE ARE NOT RESPONSIBLE FOR THE USE BY OTHERS OF THE PERSONAL DATA THAT YOU DISCLOSE IN PUBLIC POSTING AREAS. 

SECURITY AND DATA RETENTION

We use a combination of physical, technical, and administrative safeguards to protect the data we collect through the Sites. While we use these precautions to safeguard your data, we cannot guarantee the security of the networks, systems, servers, devices, and databases we operate or that are operated on our behalf. Consequently, we cannot ensure or warrant the security of any data you transmit to us, and you understand that any data that you transfer to us is done at your own risk. If we learn of a security system breach we may attempt to notify you electronically so that you can take appropriate protective steps. By using the Sites or providing personal data to us, you agree that we can communicate with you electronically regarding security, privacy and administrative issues relating to your use of the Sites. We may post a notice via our Sites if a security breach occurs. We may also send an email to you at the email address you have provided to us in these circumstances. Depending on where you live, you may have a legal right to receive notice of a security breach in writing. If you create an account on our Sites, you are responsible for maintaining the security of your password at all times. You may gain access to and review your personal data by accessing your account. You are responsible for activity occurring while logged in to your account.

We will retain your personal data for as long as needed to fulfill the purpose for which it is collected and to comply with our legal obligations, resolve disputes, and enforce our agreements. 

INTERNATIONAL DATA TRANSFERS 

If you are visiting our Sites from a location outside of the United States, your connection may be through and to servers located in the United States. Any data you provide during your visit will be processed and maintained on our server and other internal systems located within the U.S. or otherwise as described above. You acknowledge and understand that by providing your personal data to us, your personal data (i) will be used for the uses identified above in accordance with this Privacy Policy, and (ii) may be transferred to the U.S. as indicated above, in accordance with applicable law. By using the Sites, placing an order with us, and/or providing us with this data, you acknowledge this transfer, which may not offer the same level of data protection as the country where you reside and you do not require separate notification of each such transfer that occurs.

FINANCIAL INCENTIVES, OFFERS, AND BONA FIDE LOYALTY PROGRAMS 

We may offer you financial incentive programs or bona fide loyalty programs like discounts and special offers in exchange for your personal data. The personal data requested in connection with the offer, as well as other terms, will be provided at the time you sign up. We may share your data with service providers and marketing partners to provide the program. We will provide the name of any program partners at the time you sign up.  In calculating these offers, we consider the expenses related to the offer and the value of your data.

You may withdraw from any of the programs at any time by following the instructions provided.  Please note that if you opt out or request to delete your data, we may no longer be able to provide you with the benefits. For offers involving your e-mail, you may unsubscribe via the “unsubscribe” link in any marketing email you have received.  For offers involving text messaging, you may text STOP.  For all other offers, you may follow the instructions provided with the offer. 

YOUR OPTIONS AND RIGHTS REGARDING YOUR PERSONAL DATA

Your Account: Please visit your account to update your account information.

Email Unsubscribe: If you do not wish to receive marketing information from us or wish to opt out of future email promotions from us, please contact us. Please note that all promotional email messages you receive from us will include an option to opt out of future email communications.

SMS or Text Marketing: If you have given permission, we may contact you by SMS or text message about products, promotions, and special offers that may be of interest to you. You may opt-out of these marketing messages any time by texting STOP or by contacting us. 

Do Not Track and Opt-Out Preference Signals: Your browser or device may include “Do Not Track” functionality. The personal data collection and disclosure practices and the choices that we provide to you will continue to operate as described in this privacy policy regardless of whether a Do Not Track signal is received. We honor the Global Privacy Control as another way to opt out of the sale of your personal data or the sharing of it for targeted advertising purposes. The GPC is available here. PAPATUI responds to consumer rights requests according to local law. Depending on your U.S. state of residence, the following rights may be available to you, subject to some exceptions: 

  • Right to access and portability: You may have the right to confirm whether your personal data is being processed and to get access to it, and a portable format of it, if you request. Residents of Oregon may also request a list of specific third parties, other than individuals, to which PAPATUI has disclosed your personal data. Where possible and allowed by law, we will provide a copy of the personal data we are processing. For more copies, we may charge a reasonable fee. If you make the request by electronic means, and unless otherwise requested, the data shall be provided in electronic form. 
  • Right to correction, rectification, and completion: You may have the right to correct, rectify, or complete your personal data if inaccurate or incomplete. 
  • Right to delete or erasure (“right to be forgotten”): You may have the right to the deletion or erasure of your personal data. 
  • Right to restriction of processing: You may have the right to request that we restrict our processing of personal data.
  • Right to object to processing: You may have the right to object to processing of your personal data which is based on our legitimate purposes. 
  • Right to opt-out of profiling: If we base decisions solely on profiling or automated decision-making that may result in legal or other important effects, you may have the right to opt-out. 
  • Right to opt-out of the sale of personal data or the sharing of personal data for targeted advertising purposes: You may have the right to opt-out of the sale of your personal data to third parties and to opt-out of the sharing of your personal data for targeted advertising purposes. To exercise this right, you may submit a request by contacting us. 
  • Right to limit the use and disclosure of sensitive personal data: You may have the right to limit the use and disclosure of your sensitive personal data if we use such information to infer characteristics about you. We do not use your sensitive personal data for these purposes, so PAPATUI does not provide the right to limit. 
  • Right to Nondiscrimination: We will not discriminate against you for exercising any of these rights.

California’s “Shine the Light” Law: California residents may request certain information regarding our disclosure of personal data to third parties for their direct marketing purposes. We do not sell your personal data to third parties for their direct marketing purposes. 

Nevada Revised Statutes: Residents of Nevada have the right to opt out of the sale of certain personal data to third parties. We currently do not sell your personal data as defined by Nevada law.

Note that there are restrictions on the number of times you can exercise some of these rights. In some states, you may designate an authorized agent to make a request on your behalf. The agent must provide proof of your authorization. We may deny a request from an agent that does not submit proof that they have been authorized by you to act on your behalf. 

We must verify your identity before responding to your request. We verify your identity by asking you to provide personal data that we can match against personal data we may have collected from you previously. We may need to follow up with you to request more personal data to verify identity. We will not use personal data we collect in connection with verifying or responding to your request for any purpose other than responding to your request.

We may have a reason under the law why we do not have to comply with your request, or why we may comply with it in a more limited way than you anticipated. If we do, we will explain that to you in our response. You may have the right to appeal a denial of your request by contacting us as described in the notice of denial.
